CCRC REPLY TO DATE:
We have recently had an update via letter from the CCRC; they wrote:
“I have reviewed and considered the remaining trial material. I have also considered the appeal documents and worked through Mr Garbutts’ previous CCRC applications”
We, our legal team, asked the CCRC to review and look into specifically the following evidence found:
- The DNA on both the metal bar (murder weapon) and pillar
- The balaclava and BB gun found at a neighbouring pub.
The CCRC are now deciding whether Mr Garbutts’ case should be assessed by their forensic team about the potential forensic opportunities.
The CCRC also wrote saying, “I am now in the process of obtaining the police file and the forensic files”
We, our legal team, are pleased they are doing this and see this as a positive sign that the CCRC are now looking into the case more thoroughly than ever before as, to our knowledge, they have never actually asked for the mountain of police and forensic files. Yes we have been angry, disheartened and felt let down that this hasn’t been done in previous applications but instead of dwelling on what can’t be changed we move forward and are reignited once again that there is hope Robins’ truth will be heard.
We truly hope that them asking for the police and forensic files along with the horizon investigation details is a sign that the CCRC are hopefully now doing a thorough investigation into Robins’ case so they can establish that his trial was unfair and unsafe.
Finally, the letter concludes with, “I will write to you with an update by the end of December”
So for now, we wait again. Thank you for taking the time to read this and we hope you are all well.
